Senators have days, not weeks, to get the crypto Clarity Act to the floor. And as of Wednesday afternoon, the clock was winning.
Senate Majority Leader John Thune declined to file cloture on the crypto market structure bill Wednesday afternoon, according to Punchbowl News. That single procedural non-move is the whole story. Without cloture, negotiators are left with a narrow window to produce something that resembles consensus before the chamber empties out.
Thune had told reporters earlier the same day that he still hoped for a vote before the break. Republican and Democratic staff reportedly held a flurry of meetings over the prior 24 hours trying to close out the remaining disagreements.

Here’s the part that matters more than the floor schedule. Bipartisan language drafted and sent to the White House last week is being reviewed there right now, Senator Thom Tillis said.
“We’ve got people working with White House right now…they’re going through some of the lines right now,” Tillis was quoted as saying, first reported by Punchbowl News Senior Reporter Brendan Pendersen.
Going through some of the lines. That’s not a rubber stamp. That’s edits, and edits take days the Senate doesn’t have.
Tillis, who has been working with Democrats on the ethics language, put the odds bluntly. Everything depends on whether the Senate stays in Washington past its scheduled Thursday departure.
“If we were getting out on schedule, which would be tomorrow afternoon, I think it’d be a moonshot at this point,” Tillis said. “But there’s still a chance if we’re going to be delayed, particularly if we have to go into next week.”

Industry support hasn’t moved the calendar
Top crypto companies sounded optimistic last week. Coinbase among them. Major financial institutions have lined up behind the bill.
None of it appears to have changed the queue. Lawmakers look to be prioritizing other bills ahead of a five-week break that starts Thursday or Friday.
That’s the gap worth watching. Corporate endorsements and floor time are different currencies, and only one of them buys a cloture filing.
The blame is already being assigned
Republicans including Senator Cynthia Lummis have said Democrats are deliberately holding back the bill. Make of that what you will heading into a recess where nobody has to answer for it.
Outside the Senate floor, the push continues. South Carolina Republican Darline Graham posted on X backing swift passage, framing the Clarity Act as central to President Trump’s effort to keep digital-asset innovation in the U.S.
Graham said the Senate needs to deliver a bill that protects consumers, arms law enforcement and gives the industry regulatory certainty. She added that she stands ready to back Senate Banking Chairman Tim Scott, Lummis and the president in getting the legislation “across the finish line.”
What to actually watch on Thursday
One event decides this. If cloture gets filed Thursday, a floor vote could still land as soon as this weekend.
If it doesn’t, the bill’s best remaining shot at passage before recess is a delay that pushes the Senate into next week. Which means the most useful thing you can track isn’t a whip count or a press release. It’s whether senators go home on schedule.
